Where is the divorce application submitted?
It is submitted to the competent court according to the place of residence of the spouses, i.e. the court where the last common residence of the spouses was.
Is the court competent or a notary?
Divorce is under the jurisdiction of the Basic Court according to the place of residence of the spouses.
What documents do I need for divorce?
To start, you will need a Birth Certificate for both spouses (and children if you have any), a Marriage Certificate, and a Real Estate Ownership Certificate from the cadastre.
Do I need a lawyer for divorce?
Yes, it would be advisable to have a lawyer, but it is not mandatory, especially if it is an uncontested divorce proposal. A lawyer will assist you in preparing documentation, advise you on legal issues, represent your interests in court proceedings, and ensure that nothing is overlooked.
To whom will the children be entrusted after the divorce?
Parenting agreement, which is a document regulating the way parents will exercise their parental rights in cases of divorce or separation. If parents fail to reach an agreement on the exercise of parental rights, the court will decide on how parental rights will be exercised. The parenting agreement can be concluded in court or out of court.
How long does an uncontested divorce take?
