Once an agreement on price and terms is reached, the next step is drafting the real estate purchase contract. This step involves preparing all necessary documents and thoroughly defining all terms of the purchase.
Before signing the contract, it is recommended to verify the legal status of the property. This includes checking ownership rights, mortgages, encumbrances, or other restrictions that may affect the property and its ownership. Following this, the contract is signed and notarized by the competent notary public. After signing the contract, the process of transferring ownership of the property follows. This includes registration in the cadastre and payment of all relevant taxes and fees.
What are the legal obligations of the buyer and seller?
The obligations of the seller:
The seller should prepare all necessary documents for the transfer of ownership of the real estate, such as proof of ownership and other relevant evidence. Before concluding the contract, the seller is obliged to clear the property from all encumbrances, mortgages, or other restrictions that could affect the ownership of the property.”
